Advised an upstream oil and gas operator following the non-delivery of critical equipment under a time-sensitive procurement contract. The advice tested whether the client’s payment profile was sufficient, in substance, to engage delivery obligations, how an arbitral tribunal would assess that issue in context, and the viability of contractual defences. Remedies, enforcement and replacement risk, arbitration timing and cost exposure, and arbitrator selection were assessed to support a commercially grounded go-forward decision.

Secured regulatory engagement and oversight, achieved full performance of the guarantee obligations, and stabilised the underlying supply relationship on revised, commercially sustainable terms.
Advised and represented a seismic services company on dispute strategy arising from the Government’s exercise of back-in rights over substantial concession areas, despite significant sunk investment. Through regulatory engagement and negotiation, secured a restructuring of the affected acreage, revised and resized on improved commercial terms.
